Pension provision for civil servants is governed by the provisions of the Law of Ukraine No. 1058-IV of July 9, 2003, "On Mandatory State Pension Insurance," in accordance with Article 90 of the Law of Ukraine "On Civil Service" No. 889 of December 10, 2015 (https://t1p.de/d2osr).
At the same time, paragraphs 10 and 12 of Section XI, "Final and Transitional Provisions," of Law No. 889 preserve the right to receive a pension under Article 37 of the Law of Ukraine No. 3723-XII of December 16, 1993, "On Civil Service" (https://t1p.de/uijsi). Under this provision, a pension may be granted if, as of May 1, 2016:
◽️ the individual had at least 10 years of service in positions classified within the relevant categories of the civil service under Article 25 of Law No. 3723-XII and the corresponding regulations of the Cabinet of Ministers of Ukraine, and was serving as a civil servant on May 1, 2016; or
◽️ the individual had at least 20 years of service in positions classified within the relevant categories of the civil service under Article 25 of Law No. 3723-XII and the regulations of the Cabinet of Ministers of Ukraine, regardless of whether they were serving as a civil servant on May 1, 2016.
In accordance with the Procedure for Granting Pensions to Certain Categories of Persons, approved by Cabinet of Ministers Resolution No. 622 of September 14, 2016 (https://t1p.de/5sj1m), the right to receive a pension under Article 37 of Law No. 3723-XII is granted to individuals who have the required insurance record for an old-age pension at the minimum amount under the first paragraph of Part One of Article 28 of the Law of Ukraine "On Mandatory State Pension Insurance", as well as the required civil service record. Eligible persons include:
🔹 men aged 62 or older;
🔹 women who have reached the statutory retirement age established by Article 26 of the Law of Ukraine "On Mandatory State Pension Insurance."
A civil servant's pension is granted from the date of application, but not earlier than the date on which the individual becomes eligible. The pension amount is 60% of the salary.
The calculation includes all salary components on which the unified social contribution (USC) has been paid. For individuals who are no longer employed as civil servants at the time of application, the pension is calculated based on the salary of a civil servant holding the corresponding position and rank at their last place of employment.
Cabinet of Ministers Resolution No. 823 of July 12, 2024, "On Amendments to the Procedure for Granting Pensions to Certain Categories of Persons," introduced amendments to Procedure No. 622, effective January 1, 2024.
In particular, the amendments establish the procedure for granting pensions to civil servants who, from January 1, 2024, worked in state authorities that implemented the new civil service position classification, as well as to those who were not transferred to positions under the new staffing schedule or who left their positions before that date.
