Conditions for Payment of Compensation and Certain Types of Assistance Provided by Ukrainian Law to Citizens Affected by the Chornobyl Disaster

Starting from July 1, 2025, the Pension Fund of Ukraine will assume responsibility for the payment of compensation and certain types of assistance to individuals affected by the Chornobyl disaster. This is in accordance with the Law of Ukraine “On the Status and Social Protection of Citizens Affected by the Chornobyl Disaster” dated February 28, 1991, No. 796-XII, and the Resolution of the Cabinet of Ministers of Ukraine dated September 20, 2005, No. 936 “On Approval of the Procedure for Using State Budget Funds for Programs Related to the Social Protection of Citizens Affected by the Chornobyl Disaster” (hereinafter — the Procedure).

Types of compensation and assistance provided under paragraph 4 of the Procedure:

🔹 Assistance to individuals affected by the consequences of the Chornobyl nuclear accident in the amount of three times the average monthly salary in the event of dismissal due to liquidation, reorganization, or re-profiling of an enterprise, institution, or organization, or due to downsizing;

🔹 Assistance in the form of compensation for the difference between the previous and new (lower) salaries when a person is transferred to a lower-paid position due to health reasons, until disability is officially recognized or recovery occurs;

🔹 Reimbursement of average salary for up to 14 working days during relocation to a new place of residence for citizens from among those affected by the Chornobyl disaster who are evacuated or resettled from areas of radioactive contamination;

🔹 Payment for an additional leave of 14 working days to individuals affected by the Chornobyl disaster;

🔹 Payment of the difference in the duration of annual leave between what is granted under Article 47 of the Law of Ukraine “On the Status and Social Protection of Citizens Affected by the Chornobyl Disaster” and the leave duration provided under the Law of Ukraine “On Vacations” or other laws, for citizens working (or on assignment) in radioactive contamination zones;

🔹 Salary supplements for individuals working in the Exclusion Zone, in accordance with Article 39 of the aforementioned Law.

Payment Process

These types of assistance and compensation are provided at the primary place of employment (service) by enterprises, institutions, organizations, military units, and private entrepreneurs, based on the calculation data submitted to the authorized body using the form approved by the Ministry of Social Policy (paragraph 5 of the Procedure).

Application Requirements

In order to receive compensation and assistance, enterprises must register with the authorized body no later than two months before the beginning of each budget year and submit the following:

✔ Information about the enterprise, specifying the number of affected individuals by recipient category and the number of employees working in areas of radioactive contamination;

✔ Lists of eligible citizens, including full name, category, certificate series and number (if available), place of residence (or stay), taxpayer registration number or passport series and number with a note on the refusal to accept such a number, or the taxpayer registration number data from the State Register of Individual Taxpayers as entered into the Ukrainian citizen's passport.
