Court-Ordered Pension Payments: Government Establishes New Funding Procedure

On August 19, 2026, the Cabinet of Ministers of Ukraine adopted Resolution No. 1046, which outlines a updated mechanism for funding pensions calculated or recalculated pursuant to court decisions.

Scope of the Resolution:

Pensions recalculated based on court rulings.

Accumulated arrears accrued for periods prior to the court decisions coming into legal force.

Key Financial & Operational Principles:

Proportional Allocation: Funds allocated for court-mandated pension payments will be distributed proportionally among beneficiaries listed in electronic pension files and the corresponding PFU registry.

Budget-Dependent Payouts: Actual monthly payout amounts will directly depend on the total volume of state funds earmarked for these specific purposes.

Guaranteed Minimum:** For individuals whose pensions were directly ordered to be assigned by a court, a statutory guarantee applies: the monthly payment following proportional distribution cannot fall below the legally established subsistence level for persons who have lost their ability to work (*прожитковий мінімум для осіб, які втратили працездатність*).

Practical Summary:

* Court decisions remain the valid legal foundation for calculating or recalculating pensions.

* Pension arrears will be disbursed progressively based on available state funding.

* Partial or installment payments may result in monthly disbursements that are less than the total calculated debt owed for a given period.

Resolution No. 1046 specifically regulates the financial disbursement and proportional distribution mechanics for court-mandated pension obligations.
