Drafting Employment Contracts with Minors: Rules in Peacetime and During Martial Law

The State Labor Service of Ukraine reminds the public of the specific provisions regarding the employment of citizens under the age of 18.

The right to work is exercised through the conclusion of an employment contract with a company, institution, organization, or individual; however, the terms of such contracts vary depending on the country’s legal framework.

In peacetime, a written contract is mandatory for minors, and no probationary period is established.

However, during martial law, the form of the contract is determined by mutual agreement of the parties (in the absence of a written contract, an application for employment is submitted), and it becomes possible to establish a probationary period.

Regardless of martial law, for official employment, the employer is required to issue an order (decree) of employment and send a corresponding notification to the State Tax Service of Ukraine.
