Pension provision for civil servants

Pension provision for civil servants is regulated by the provisions of Law of Ukraine No. 1058-IV of July 9, 2003, “On Compulsory State Pension Insurance,” in accordance with Article 90 of Law of Ukraine “On Civil Service” of December 10, 2015 No. 889 — https://t1p.de/d2osr).

At the same time, paragraphs 10 and 12 of Section XI “Final and Transitional Provisions” of Law No. 889 provide for the right to a pension in accordance with Article 37 of the Law of Ukraine dated 16.12.1993 No. 3723-XII “On Civil Service” (https://t1p.de/uijsi), according to which a pension is granted if, as of May 1, 2016:

◽ the person has at least 10 years of service in positions belonging to the relevant categories of civil service defined in Article 25 of Law No. 3723-XII and regulatory acts of the Cabinet of Ministers of Ukraine, and also held the position of a civil servant as of May 1, 2016;

◽ the person has at least 20 years of service in positions belonging to the relevant categories of civil service, as defined in Article 25 of Law No. 3723-XII and acts of the Cabinet of Ministers of Ukraine, regardless of whether they held the position of civil servant as of May 1, 2016.

In accordance with the Procedure for granting pensions to certain categories of persons, approved by Resolution of the Cabinet of Ministers of Ukraine No. 622 of 14.09.2016 (https://t1p.de/5sj1m), the right to a pension in accordance with Article 37 of Law No. 3723-XII, subject to insurance experience, required for the appointment of a mini um old-age pension, as provided for in the first paragraph of part one of Article 28 of the Law of Ukraine “On Compulsory State Pension Insurance” and the required length of service in the civil service, have:

🔹 men who have reached the age of 62;

🔹 women who have reached the retirement age established by Article 26 of the Law of Ukraine “On Compulsory State Pension Insurance.”

The pension for civil servants is granted from the date of application for its appointment, but not earlier than the date of the emergence of the corresponding right, in the amount of 60% of the salary. The calculation base includes all types of payments from which a single contribution to compulsory state social insurance has been paid. For persons who do not hold a civil service position at the time of application, the pension is determined based on the salary of a civil servant of the corresponding position and rank at the last place of work.

Resolution of the Cabinet of Ministers of Ukraine No. 823 of July 12, 2024, “On Amendments to the Procedure for Granting Pensions to Certain Categories of Persons,” amended Procedure No. 622 (effective January 1, 2024).

In particular, it defines the procedure for granting pensions to civil servants who, as of January 1, 2024, worked in state bodies that carried out the classification of civil service positions, as well as those who were not transferred to positions in accordance with the new staffing table or resigned before that date.

Taking into account the changes made, updated forms of certificates on the components of wages necessary for the appointment of pensions to civil servants were approved (Appendices 1-6 to Order No. 622).
