In the event of failure to comply with requirements regarding the prevention and resolution of conflicts of interest, as well as other restrictions aimed at preventing corruption, a person may be subject to, among other things, administrative and disciplinary liability.
Administrative liability is provided for violations of specific requirements regarding the prevention and resolution of conflicts of interest (Article 1727 of the Code of Administrative Offenses):
if a person fails to disclose the existence of an actual conflict of interest in the cases and in the manner prescribed by law—a fine of 1,700 to 3,400 hryvnias (Part 1 of Article 1727 of the Code of Administrative Offenses);
taking actions or making decisions while an actual conflict of interest exists—a fine of 3,400 to 6,800 hryvnias (Part 2 of Article 1727 of the Code of Administrative Offenses);
any of the above violations committed by a person who, within the past year, has already been subject to an administrative penalty for a similar offense—a fine ranging from 6,800 to 13,600 hryvnias, along with disqualification from holding certain positions or engaging in certain activities for a period of one year (Part 3 of Article 1727 of the Code of Administrative Offenses).
Disciplinary liability is provided for:
failure to notify a supervisor of a potential conflict of interest;
a supervisor’s failure to resolve a subordinate’s conflict of interest;
failure to transfer corporate rights to management, violation of the deadlines for such transfer, untimely or failure to notify the National Agency for Corruption Prevention (NAZK), as well as failure to provide a notarized copy of the agreement regarding such transfer.
Persons performing state or local government functions, as well as those deemed equivalent to them, are required to:
take measures to resolve an actual or potential conflict of interest;
refrain from taking actions or making decisions in situations involving an actual conflict of interest;
take measures to prevent the emergence of an actual or potential conflict of interest;
notify their immediate supervisor no later than the next business day after the person became aware or should have become aware of an actual or potential conflict of interest, and, if the person holds a position that does not involve a direct supervisor, or serves on a collegial body—the National Agency for the Prevention of Corruption or another body or collegial body designated by law—the conflict of interest arose while performing duties within that body, respectively.
