If, due to hostilities, you relocated to a safer region, obtained internally displaced person (IDP) status, or are staying in an area where active fighting is taking place, and your employment relationship with your employer has not been formally terminated, you have the right to end the employment contract unilaterally.
1. Submitting an application unilaterally
To obtain unemployment status, you need to submit an application addressed to your employer requesting termination of the employment contract to any employment center in Ukraine, regardless of your place of residence.
2. When is the contract considered terminated?
The process is оперативний: the date of termination is the day following the submission of your application to the employment center.
3. Notification of authorities
The employment center will notify:
Your employer;
The territorial body of the Pension Fund of Ukraine;
The State Tax Service.
4. Obtaining unemployment status
Unemployment status is granted from the date of submitting the relevant application — that is, from the day after the termination of employment.
Legal framework:
Law of Ukraine No. 1706-VII (Article 7, Part 4) — establishes the right to unilateral termination of an employment contract
Labor Code of Ukraine (Articles 36, 38, 39) — general grounds for termination of employment
